11. Employees, officers and directors of Promoter and its affiliated companies are not eligible to participate in the Promotion. Any such entries will be deemed as void.
12. To be eligible to participate in the Promotion and submit a valid redemption claim, participants must have registered for the Milwaukee MyAccount, available here: [insert link to sign up page for the relevant country] at the time of the redemption claim submission. Claims submitted without an active Milwaukee MyAccount will be deemed invalid and no Redemption will be issued.
13. Proof of eligibility may be required, and Redemptions may be withheld until Promoter is fully satisfied the above criteria are met. Promoter's decision is final, and no correspondence or discussion will be entered into.
14. The Promotion is only available to participants who purchase Milwaukee products that meet the Qualifying Spend (Annex 1) from a Participating Milwaukee Retailer.
15. Applications from organised groups, third parties, agents, macros or other automated means, will not be eligible. Incomplete applications or applications that are not in accordance with this Agreement or the application instructions will be rejected.
16. Tools Kits created by dealers are not eligible for redemption claims. Qualifying Spend must be from original Milwaukee product as outlined in Annex 1.
17. This Promotion does not apply to any non-listed Milwaukee products during the campaign or any products purchased outside of the Promotion Period.
CLAIM PROCESS
18. To claim this Promotion, once participants have purchased Milwaukee products equal to or above the Qualifying Spend from a Participating Milwaukee Retailer within the Promotion Period and signed up for a Milwaukee MyAccount here: [insert link to account sign up for the relevant country] a claim form must be completed within your Milwaukee MyAccount and submitted online within 30 days from the day of purchase and before the end of the Promotion Period, using the following link:Redemption Form | Milwaukee Tools South Africa Participants must upload a fully legible copy of the purchase receipt as part of the claim. The uploaded proof of purchase must display all required information, being the model number and/or description of the Qualifying Spend, the price paid for the Qualifying Spend, that the Qualifying Spend was purchased from a Participating Milwaukee Retailer, a picture copy of the barcode on the receipt (if apply), and the date of purchase.
19. Participants must submit their claim within the specified promotional Promotion Period. Any claims submitted before or after the Promotion Period will be invalid.
20. Once a participant has submitted their claim, an email acknowledging receipt of the claim will be sent to the email address the participant has provided, which will include details of the claim and a unique reference number. If your claim is successfully approved within 7 working days, you will receive a notification by email. Your Redemption will be ready to be picked up at the same Store of the purchase after 15 working days. Your Redemption will require a confirmation of the same Reference Number received by email along with the same data provided on the claim. If there are any queries with your claim, or more detail is required, you will be contacted on the email address provided within 28 working days of the claim submission date. If you do not receive your Redemption within 28 working days of your claim submission date, please contact Promoter at [email protected] quoting your name, address and claim number. If your claim is unsuccessful, an email notifying of this will be sent to the email address the participant has provided.
21. Any claims made in respect of the Qualifying Spend that are subsequently returned to the retailer for any refund are deemed void, and the Participant must immediately notify Promoter at  [email protected] to cancel the claim and return the Redemption at their own expense to the Promoter's address above.
22. The Promoter reserves the right to verify with a Participating Milwaukee Retailer the eligibility of all claims to protect itself against fraudulent, invalid or repetitive claims including, without limitation, to require the participant to prove that it did not return the product within the period of 30 days from the date of purchase. The Promoter recommends that participants retain their packaging for the products until they have received their Redemption, just in case validation is required. Participants acknowledge that the Promoter may contact Participating Milwaukee Retailers for such purpose. Claims for returned products, bad faith or fraudulent entries or claims that otherwise do not meet the terms under this Agreement, will be invalidated and the participant will not receive a Redemption.
23. All claims must include the participant's full name, email address, telephone number and a valid residency address. The Promoter will not be held responsible or liable for any technical, hardware, software, server, website or other failures or damage of any kind, to the extent that this prevents the participant from or otherwise obstructs the participant to enter in the Promotion. Claims made by fax, telephone or post will not be accepted. Incomplete claim forms will be deemed void, as will claim forms not completed in accordance with this Agreement.
24. Online entry is free however internet connection and mobile data rates may apply to the participant. The cost of accessing the promotional website will be dependent on the participant's individual internet service provider and shall be the responsibility of the participants only. Promoter holds no liability to cover entrance costs.
25. The Promoter will deliver Redemption to the specified Store address where the purchase was made. The participant is responsible for the collection of the Redemption at the store location within 30 days. If the Participant does not collect within the specified timeframe, the Redemption is subsequently returned to the Promoter.
MANUFACTURER WARRANTY
26. A manufacturer warranty will be provided to the Redemption supplied via this Promotion, which is available under this link Guarantee conditions - Milwaukee. The length of guarantee specific to your goods will be also clearly identified on/in the packaging of the goods or contained within the relevant product documentation.
27. During the manufacturer’s warranty period, if there is a fault in workmanship or material which existed at the date of Redemption you may be entitled to a repair and/or replacement of the faulty product, provided you have the delivery note and you give the Promoter the opportunity to inspect the faulty goods. 28. In certain circumstances we will offer goods with an extended warranty period. The eligibility of goods and the length of any extended warranty offered will be clearly identified on/in the packaging of the goods or contained within the relevant product documentation. Any extended warranty offered is subject to you completing the registration process required to qualify for this extended warranty. GENERAL CONDITIONS
29. Personal data relating to the participants will be used for the purposes of this Promotion in accordance with applicable data protection legislation and the Promoter's Privacy Statement available at Privacy Policy | Milwaukee Tools South Africa. The Promoter validate your claim and arrange for the collection of your Redemption at the store where the purchase was made. If participants give their consent to the processing of their personal data for Promoter's marketing purposes, the Promoter reserves the right to contact them regarding various Milwaukee product and service promotions or other related communications. Participants can withdraw consent to such use of personal information by writing to Promoter at the email address set out above or by using the opt-out link in the promotional emails.
30. The Promoter shall not be liable for any disruption to the Promotion whether due to force majeure or other factors beyond the Promoter's control.
31. In accordance with all relevant legislation and codes of practice, the Promoter reserves the right to suspend or modify this Promotion. If such modification or suspension occurs, Promoter will post a notice of such on Promoter's website as soon as is practically possible.
32. To the extent permitted by law, Participants agree to release and hold the Promoter harmless from any and all liability whatsoever for any losses or damages of any kind arising from participation in or in connection with the Promotion, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the Redemption. The above limitation of liability shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of Promoter's negligence.
33. This Promotion is not available in conjunction with any other offer or promotion.
34. If the Redemption is taxable then the Participant is responsible for ensuring the necessary reporting and payment of any applicable tax on the value of the Redemption to the relevant tax authority.
35. If any provision of this Agreement is held invalid by any law or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
36. This Agreement is governed by German Law. The choice of law does not affect the protection to which the consumer is entitled under the mandatory provisions of the country in which he or she has his or her habitual residence. If the participant is an entrepreneur, a legal entity under public law or a special fund under public law, the place of jurisdiction for all legal disputes is Winnenden, Germany.
